Fair Competition Code

Japanese: 公正競争規約 - こうせいきょうそうきやく

Based on Article 10 of the Unfair Premiums and Misrepresentations Prevention Act, a business operator or business association, with the approval of the Fair Trade Commission, voluntarily concludes or establishes an agreement or rule on matters related to premiums or representations in order to prevent unfair customer inducement and ensure fair competition. If one business operator among businesses in a certain competitive relationship offers an unfair premium or engages in an act that is considered to be a misrepresentation, the other business operators will have no choice but to respond with a similar act. The purpose of the fair competition rules system is to prevent such an outcome and maintain a fair competitive order.

不当景品類及び不当表示防止法第 10条に基づいて，事業者または事業者団体が，公正取引委員会の認定を受けて，景品類または表示に関する事項について，不当な顧客の誘引を防止し，公正な競争を確保するために，自主的に締結しまたは設定する協定または規約。一定の競争関係にある事業者のうち，一事業者が不当な景品類の提供あるいは不当表示とされる行為を行えば，他の事業者も同様の行為をもって対抗せざるをえないことになる。このような結果を防止し，公正な競争秩序を維持することに，公正競争規約制度の目的がある。
