Pollution Dispute Resolution Act

This law was enacted in 1970 with the aim of swiftly and fairly resolving pollution disputes by establishing a system of mediation, conciliation, arbitration and adjudication. It was Act No. 108 of 1970. The law established the Pollution Adjustment Committee (also called the "Central Committee") at the national level (Article 3), and prefectures may establish Prefectural Pollution Review Boards (also called the "Review Boards") as prescribed by ordinance (Article 13). The Central Committee has jurisdiction over disputes in which pollution damage has caused significant pollution damage to human health or the living environment and has affected a considerable number of people, and disputes that need to be resolved from a broad perspective across two or more prefectures (Article 24, Clause 1), while the Review Board has jurisdiction over other disputes (Article 24, Clause 2).

公害紛争について、斡旋(あっせん)、調停、仲裁および裁定の制度を設けることなどにより、紛争の迅速かつ適正な解決を図ることを目的として1970年に制定された法律。昭和45年法律第108号。同法により中央に公害等調整委員会（「中央委員会」などとよぶ）が設置され（3条）、都道府県は条例で定めるところにより都道府県公害審査会（「審査会」などとよぶ）を置くことができる（13条）。中央委員会は、人の健康または生活環境に著しい公害被害が生じ、その被害が相当多数の者に及ぶような紛争、および二つ以上の都道府県にわたり広域的な見地から解決する必要があるような紛争などを管轄し（24条1項）、審査会はそれ以外の紛争を管轄する（同2項）。
