The virtue of the Kenmu period

Japanese: 建武の徳政 - けんむのとくせい

The Tokuseirei (decree of amnesty) was issued by the Kenmu government in May 1334 (Kenmu 1). Currently, the two provisions that are known to us are as follows: (1) Loans, repayment of principal, and indentures must be settled at the time of issue, and if repayments made through interest and crops exceed half the principal, not only must the pawned fields and farmland be returned to their owners, but also the excess amount; (2) For land sold after the Jokyu era, even if the buyer had received a letter of assurance from the Kamakura shogunate, if the buyer joined the enemy side and was destroyed, the land must be returned to its owners; if the buyer was an ally and had military loyalty, assurance may be given to the buyer depending on the case; and all land sold after the Genko 1st year (1331) must be returned.

1334年(建武1)5月発布された建武政府の徳政令。現在知られているのは次の2ヵ条。(1)借銭，本銭返し，年季売などは，現時点で決済し，利息や収穫物などによる返済が元金の半額を超していれば，質物の田畠はもちろん，超過支払分も本主に返還，(2)承久年間以後の売却地は，たとえ買得人が鎌倉幕府の安堵状を得ていても，買主が敵方について滅亡した分は本主に返還，買主が味方につき軍忠がある場合は，ケースによって買主側に安堵，元弘1年(1331)以後の売買分は全て返還。
