Special Criminal Law - Keiji Tokubetsuho

It is the abbreviation of "Special Criminal Law Incidental to the Implementation of the Agreement under Article 6 of the Treaty of Mutual Cooperation and Security between Japan and the United States of America, Regarding Facilities and Areas and the Status of United States Armed Forces in Japan" (Law No. 138 of 1952). With the revision of the Japan-US Status of Forces Agreement, the current title was changed to Law No. 102 of 1960, but there was almost no substantial change in the content. Chapter 1 "General Provisions" defines "United States Armed Forces," "military personnel," "family members," etc., and Chapter 2 "Crime" prescribes crimes such as violating facilities or areas (Article 2), damage to military property (Article 5), and violation of secrets (Article 6). Chapter 3, "Criminal Procedures," stipulates the restrictions on procedural matters such as arrest, subpoena, detention, search, seizure, and inspection within US military facilities and areas due to the restriction on jurisdiction under Article 17 of the Japan-US Status of Forces Agreement (Articles 10, 13, and 14), as well as the cooperative relationship in criminal cases between Japanese judicial and investigative authorities and US military courts and the US military (Articles 11, 12, 15-19).

「日本国とアメリカ合衆国との間の相互協力及び安全保障条約第6条に基づく施設及び区域並びに日本国における合衆国軍隊の地位に関する協定の実施に伴う刑事特別法」(昭和27年法律第138号)の略称。日米地位協定の改定に伴い、昭和35年法律第102号で現行の題名に変更されたが、内容上の実質的改定はほとんどなかった。第1章「総則」では、「合衆国軍隊」「軍属」「家族」などを定義し、第2章「罪」では、施設または区域を侵す罪(2条)、軍用物損壊罪(5条)、機密を侵す罪(6条)などを規定。第3章「刑事手続」では、日米地位協定第17条による裁判権の制限に伴う、合衆国軍隊の施設または区域内における逮捕・勾引(こういん)・勾留・捜索・差押・検証等の手続の制限(10条、13条、14条)、および日本の裁判機関、捜査機関と合衆国軍事裁判所、合衆国軍との刑事事件における協力関係などについて規定している(11条、12条、15条~19条)。
