Law No. 28 of 1890 (Property, Acquisition of Property (Non-Inheritance), Security of Claims, Evidence), Law No. 98 of the same year (Acquisition of Property (Inheritance), Personnel). Civil Code promulgated in 1890. It was compiled mainly by G. Boissonade, who was invited from France by the Meiji government. It was supposed to be enforced in 1893, but a fierce debate ensued between those in favor of its enforcement and those in favor of its postponement, as it did not take into account old Japanese customs (→ Civil Code debate). In the end, the postponement faction won, and the Imperial Diet in 1892 postponed its enforcement until 1896 for revisions, but the Code Investigation Committee proceeded with the compilation of a new Civil Code (→ Civil Code), which was enforced in 1898, and the old Civil Code was never enforced. The old Civil Code was close to the French Civil Code as a whole, and the original draft of the section regarding family inheritance, in which Boissonade was said to have had no involvement, was progressive, but it became more conservative during the deliberations of the Legal Investigation Committee and the Senate. 明治 23年法律 28号 (財産編,財産取得編〈非相続〉,債権担保編,証拠編) ,同年法律 98号 (財産取得編〈相続〉,人事編) 。 1890年公布の民法典。明治政府がフランスから招いた G.ボアソナードが中心となって編纂した。 93年に施行されることになっていたが,日本の旧慣を顧慮していないということなどから,その施行につき断行論者と施行延期論者との間に激烈な論争が行われた (→民法典論争 ) 。結局延期派が勝って,92年の帝国議会で,修正のため 96年までその施行が延期されたが,法典調査会によって新たな体系による民法典 (→民法 ) の編纂が進められ,98年に施行されたので,旧民法はついに実施されずに終った。旧民法は全体としてフランス民法に近く,ボアソナードが関与しなかったといわれる親族相続に関する部分も原案は進歩的であったが,法律取調委員会および元老院の審議の過程で保守化されていった。
