Filibuster - filibuster

The deliberate disruption of parliamentary proceedings and votes through legal means such as lengthy speeches, the introduction of various motions, and requests for quorum counts. Usually carried out by the minority.

In the United States, it is called a filibuster, but the word comes from the Dutch word vry buiter, which means a pirate who ravaged Spanish West Indies in the 17th century. Later, it came to mean a person who waged a private war against a foreign country, and since the 19th century, it has been used to mean filibuster in legislation in Congress. In the American Senate, which has a tradition of free debate, filibusters are often used by long speeches. It is used as a tactic by the minority to amend or withdraw a bill or to run out of time at the end of a session, rather than for the purpose of pure debate against bills submitted by the majority. It is carried out by individuals or groups, and there are records of 18 hours by Robert M. Lafollette in 1908, 15 hours by Huey P. Long in 1935, and 22 hours by Wayne Morse in 1953. In 1946, an organized filibuster by Southern senators opposed to the Civil Rights Bill lasted 23 days. In 1917, the Closure Rule was established to prevent excessive filibustering, making it possible to end debate by a two-thirds majority vote and take a vote, but this rule is said to be ineffective. Also, in the British Parliament, Edmund Burke gave a famous long speech in the 1770s.

In Japan, in the former Imperial Diet in 1929 (Showa 4), filibustering occurred in opposition to a bill to amend the electoral district system. Even in the Diet under the current constitution, filibustering occurred in the 19th Diet in 1954 (Showa 29), when the Socialist Party occupied the Speaker's seat of the House of Representatives, and when police officers were introduced into the House of Councillors in 1955 and the House of Representatives in 1959. The House rules regulate filibustering by submitting motions to end questions and debate (House of Representatives Rules, Articles 140 and 141, House of Councillors Rules, Article 111) and by setting time limits for open ballots (House of Representatives Rules, Article 155-2), but legal means of filibustering should be accepted from the standpoint of respecting minority opinions, apart from violent acts.

議会で、長時間の演説、各種動議の提出、定足数計算の要求などの合法的手段を利用して計画的に議事の進行や投票を妨害すること。通常、少数派によって行われる。

　アメリカではフィリバスターfilibusterとよばれるが、17世紀に西インド諸島のスペイン領を荒らした海賊freebooterを意味するオランダ語のvry buiterに由来する。のちに、外国に対して私戦を行う者をさすようになり、19世紀以降、議会における議事妨害filibuster in legislationを意味する語として用いられるようになった。自由な討論を伝統とするアメリカの上院では、長時間の演説によるフィリバスターがしばしば行われる。多数派の提出する議案に対して、純粋な討論を目的とするよりは、議案の修正・撤回または会期末の時間切れを目的とする少数派の戦術として利用される。個人またはグループで行われ、1908年ラフォレットRobert M. Lafolletteによる18時間、1935年ロングHuey P. Longによる15時間、1953年モースWayne Morseによる22時間などが記録されており、また、1946年には市民権法案に反対する南部出身議員の組織的フィリバスターが23日間に及んだ。1917年に、過度のフィリバスター防止のため、討論終結の規則the Closure Ruleが定められ、動議により3分の2の多数によって討論を終結し、採決を行うことが可能となったが、実効性に乏しいといわれる。また、イギリス議会においても1770年代にバークEdmund Burkeによって行われた長時間の演説が有名である。

　わが国では1929年（昭和4）旧帝国議会において、選挙区制の改正案に反対する議事妨害が行われた。現憲法下の国会においても、1954年（昭和29）第19国会における社会党の衆議院議長席占拠事件、55年参議院、59年衆議院への警察官導入のときに、不信任案や懲罰動議、修正案の提出、記名投票における牛歩戦術などの議事妨害が行われた。議院規則は、質疑打切りや討論終局の動議（衆議院規則140条・141条、参議院規則111条）の提出や、記名投票の時間制限（衆議院規則155条の2）により議事妨害を規制しているが、暴力的行為は別としても、合法的方法による議事妨害は、少数意見尊重の見地からは是認されるべきである。
