Appeals against refusal decisions - Kyozetsu saiteifufukushinsei

...When the right to obtain a patent is jointly owned, a patent application can only be filed by all joint owners (Article 38). A request for an appeal against a rejection decision, which is an appeal against the examination by the Patent Office, must also be filed by all owners jointly (Article 132). There are no provisions in the Patent Act regarding an action to set aside a decision, which is an appeal against a decision, but precedents have interpreted this as an inherently necessary joint action (see the section on joint actions), and have stated that it must be filed by all owners jointly.
