Joint guarantee - Kyodo Hosho

This refers to cases where several people assume the responsibility of guaranteeing the same principal obligation. Its legal nature is no different from a normal guarantee, but it is unique in that the joint guarantors have separate interests and are in a mutual reimbursement relationship. The former is a system in which the joint guarantors are only liable for a portion of the divided principal obligation (Civil Code Articles 456 and 427).

However, when the principal obligation is indivisible, there is no benefit of separation if there is a solidary relationship between the guarantors (joint and several guarantee) or if there is a solidary relationship with the principal obligation (joint guarantee). In the latter case, not only can a joint guarantor seek reimbursement from the principal obligation, but they can also mutually seek reimbursement from other joint guarantors (Article 465 of the same law).

同一の主たる債務について数人が保証債務を負う場合をいう。その法律的性質は、通常の保証と異ならないが、共同保証人が分別の利益を有すること、相互に求償関係にたつことで特殊性をもっている。前者は、共同保証人が主たる債務を分割した一部についてしか債務を負わない、とする制度である（民法456条・427条）。

　ただし、主たる債務が不可分の場合に、保証人間に連帯関係がある場合（保証連帯）、および主たる債務者と連帯関係にある場合（連帯保証）には、分別の利益を有しない。後者は、共同保証人が主たる債務者に対して求償できるだけでなく、相互に他の共同保証人に対しても求償できるという制度である（同法465条）。
