Mandatory Lawsuit - Gimzuke Sosho

A lawsuit seeking to order an administrative agency to take a certain action. German administrative justice law recognizes this type of lawsuit. Although it is a type of payment lawsuit, public law lawsuits seeking confirmation of an administrative agency's obligation to take a certain action can also be considered a type of obligation lawsuit in a broader sense. In Japan, there is also debate over whether obligation lawsuits can be recognized as a type of anonymous lawsuit. The prevailing view is that they should not be recognized as a type of anonymous lawsuit, as they go against the principle of separation of powers, but there is also a strong view that they should be recognized when it is unambiguously determined what the administrative agency should do. 行政庁に一定の処分を行うよう命じることを求める訴訟。ドイツの行政裁判法は，この訴訟を認めている。一種の給付訴訟であるが，行政庁の一定の処分を行うべき義務の確認を求める公法上の義務確認訴訟なども，広い意味では義務づけ訴訟の一種と考えられる。日本でも義務づけ訴訟が無名抗告訴訟の一種として認められるか問題とされている。権力分立の原則に反するなどとしてこれを否定するのが通説であるが，行政庁の行うべきことが一義的に確定される場合には認められるべきであるとする見解も有力である。
