Normative part - normative part

In Germany, Article 1 of the Labor Agreements Act (1918) stipulated that collective agreements should have normative effect (the effect of regulating individual labor contracts by mandatory law). As a result, the method of naming the clauses of the agreement that have an effect on individual union members as normative parts, and the clauses of the agreement that set rights and obligations only between the other parties to the agreement (i.e., that only have obligation effect) as obligation parts became common in academic theory. Article 16 of the Japanese Labor Union Law also inherited Article 1 of the German Labor Agreements Act and stipulated normative effect on the clauses of the agreement that set out "standards regarding working conditions and other treatment of workers." At the same time, academic theory, following the German theory, distinguished between the clauses of the agreement as normative parts with normative effect (which produce the effect of mandatory and direct rule) and obligation parts with obligation effect (which produce the effect of breach of contract in the event of non-performance).
