Draft revised criminal code - Kaisei Keiho Souan

This is a proposal for a complete revision of the Penal Code, submitted to the Minister of Justice by the Legislative Council in May 1974. In May 1963, the Legislative Council was asked to consult on a complete revision of the Penal Code, and a special committee on criminal law was established within the council, headed by Seiichiro Ono. The committee immediately began article-by-article deliberations, using the preliminary draft of the revised Penal Code published in 1961 as a reference, and in March 1972, the special committee's proposal was completed and published. Many scholars criticized this proposal for being nationalistic, overemphasizing ethics, and excessively penalizing, but it was submitted with only minor revisions. In June 1976, the Ministry of Justice announced an alternative proposal that accepted some of the criticisms, called the Ministry of Justice Criminal Affairs Bureau Proposal. After exchanging opinions with the Japan Federation of Bar Associations, revisions were made in 1995, with a focus on simplifying the wording. (→ Penal Code )

刑法を全面改正するための案で，1974年5月，法制審議会から法務大臣に答申されたもの。 1963年5月，法制審議会に刑法全面改正の諮問が発せられ，同審議会内に小野清一郎を部会長とする刑事法特別部会が設けられた。そこでは，1961年に公表された改正刑法準備草案を参考に，ただちに逐条審議に入り，1972年3月，特別部会案が完成，公表された。これに対しては，多くの学者から，国家主義的で倫理を強調しすぎ，かつ重罰主義であるとの批判があったが，ごく一部の改正を加えたのみで答申された。 1976年6月に法務省は，批判の一部を受け入れた代案を法務省刑事局案として発表した。その後，日本弁護士連合会との意見交換などを経て 1995年，表記の平易化を中心とする改正が行なわれた。 (→刑法 )
