[Civil Proceedings]
In civil procedures, international mutual assistance is provided for the collection of evidence (examination and examination of witnesses and experts) and the service of documents (service of complaints, summonses and other documents). Japan had already enacted the Law on Mutual Assistance at the Request of Foreign Courts in 1905, preparing a system for the collection of evidence and service of documents at the request of foreign countries, and European countries also established the path to international mutual judicial assistance in 1905 when the Hague Conference on International Private Law established the Convention on Civil Procedure Procedure. This convention was subsequently amended in 1954 to form the Convention on Civil Procedure Procedure (commonly known as the Civil Procedure Convention), and in 1965 the Convention on the Service Abroad of Judicial and Extrajudicial Documents in Civil or Commercial Matters (commonly known as the Service Notice Convention), which aimed to simplify and speed up the service of documents, which was included in the Convention, was established. Japan also ratified both the Civil Procedure Convention and the Service Notice Convention in 1970.

 民事手続では,証拠の収集(証人,鑑定人の尋問や検証)と書類の送達(訴状,呼出状その他の書面の送達)について国際共助が行われる。日本は,すでに1905年に〈外国裁判所ノ嘱託ニ因ル共助法〉を制定して外国からの嘱託に基づく証拠調べと書類の送達に応じうる態勢を整え,ヨーロッパ諸国も1905年にハーグ国際私法会議が〈民事訴訟手続に関する条約〉を定め,国際司法共助の道を確立した。その後,54年にこの条約を改正した〈民事訴訟手続に関する条約〉(通称,民訴条約),65年にはその一部に含まれていた書類の送達の手続の簡素化・迅速化を図った〈民事又は商事に関する裁判上及び裁判外の文書の外国における送達及び告知に関する条約〉(通称,送達告知条約)が定められ,日本も70年に民訴条約,送達告知条約の両条約を批准した。…
