裁判官を罷免するための一種の裁判手続。裁判官の身分保障について規定した日本国憲法 78条にこのことばがみられる。ここに特に「公の」とするのは,公務員の選定,罷免が国民固有の権利であるとする憲法 (15条) の趣旨を受けて,弾劾が広く国民的基礎に立って公開の手続で行われなければならないことを明らかにしようとしたものであろうと理解されている (裁判官弾劾法 26) 。
