…It is also called “public facility.” The concept of a facility seems to have come to be used as a translation of the German word Anstalt, and this concept is sometimes used in laws (Articles 2 and 3 of the State Compensation Law, Article 23 of the Local Finance Law, Article 209 and subsequent articles of the Local Autonomy Law before the 1963 amendment, etc.).

However, the State Compensation Law stipulates that the state is responsible not only for the torts of public officials (Article 1), but also for errors (defects) in the construction and management of public facilities (also called public works) such as roads, rivers, and school buildings (Article 2). Usually, the liability of the state for compensation for the torts of public officials and the errors in the construction and management of public facilities is collectively referred to as the liability for state compensation. …
