Freedom of business

Japanese: 営業の自由 - えいぎょうのじゆう

It refers to the freedom to choose and pursue a particular business, and is considered one of the economic freedoms. The Japanese Constitution's guarantee of freedom of business can be based on the freedom to choose one's occupation in Article 22 and the guarantee of property rights in Article 29. However, this freedom is subject to passive regulation for the police purpose of preventing danger to the lives and health of citizens, as well as active regulation from the perspective of social and economic policies, such as the smooth development of the national economy, promotion of social convenience, and protection of the economically disadvantaged.

特定の営業を選択し，遂行する自由をいい，経済的自由権の一つとされている。営業の自由の日本国憲法による保障は，第 22条の職業選択の自由と第 29条の財産権の保障にその根拠を求めることができる。ただしこの自由は，国民の生命や健康に対する危険の防止という警察目的からする消極的規制に加えて，国民経済の円満な発展，社会公共の便宜の促進，経済的弱者の保護等社会政策や経済政策的見地からする積極的規制も受ける。
