In the Civil Procedure Act, a plaintiff withdraws all or part of a lawsuit filed by the plaintiff, thereby withdrawing the request for a trial from the court. Withdrawals are permitted until a final judgment is made and the lawsuit is terminated. However, once the defendant has submitted a preparatory document or made a statement in a preparatory procedure or oral argument on the merits of the lawsuit, the withdrawal will not take effect without the defendant's consent. Withdrawal of a lawsuit means that the lawsuit was never pending in the first place, and the lawsuit is terminated. Therefore, all litigation actions up to that point become invalid. However, the plaintiff must bear the costs of the lawsuit. If a lawsuit is withdrawn after a judgment on the merits has been made, the court's efforts will be wasted, so the plaintiff cannot file the same lawsuit again. In addition, if both parties are absent from the oral argument hearing in the first instance and neither party requests a date within three months, the lawsuit is considered to have been withdrawn. 民事訴訟法で原告が提起した訴えの全部または一部を取り下げることで,裁判所に対し審判の要求を撤回すること。取下げは終局判決が確定し訴訟が終了するまで許される。ただし被告が本案すなわち請求について準備書面を提出しまたは準備手続もしくは口頭弁論で陳述をしたあとは,その同意がなければ効力を生じない。訴えの取下げにより,訴訟は初めから係属しなかったことになり訴訟は終了する。そのためそれまでの訴訟行為はすべて効力がなくなる。ただし原告は訴訟費用を負担しなければならない。なお本案判決があったのちに訴えを取り下げるとせっかくの裁判所の努力を無にすることになるので,原告はそのあと同一の訴えを再び提起することができない。また第一審の口頭弁論期日に当事者双方が欠席し,その後3ヵ月以内に当事者のいずれからも期日指定の申立てがないと訴えの取下げがあったものとみなされる。
