Beyond the right - Ienken
One of the rights that airlines have. The right to fly to a third country beyond the country of arrival. The right to approve is given by the transport authority of the receiving country. Until now, the exchange of route rights and the allocation of transportation capacity have been regulated and facilitated mainly by air transport agreements between the two countries. In an attempt to liberalize this, the Open Skies Agreements, which the United States began concluding with European countries other than the United Kingdom and France in 1992, have been in place. Furthermore, the interpretation of beyond rights has become one of the points of contention in the Japan-U.S. aviation negotiations. The United States emphasizes beyond rights, while the Japanese side argues that beyond rights are merely a secondary right.

航空会社のもつ権利の一つ。到着国を経由してさらに先(以遠)の第三国へ飛ぶ権利。認可権は受入れ当事国の運輸所管省庁。これまではもっぱら関係2国間の航空協定により路線権の交換,輸送力の配分を規定し便宜がはかられてきた。それを自由にしようというのが,1992年から英国,フランスを除くヨーロッパ各国などとアメリカが締結をはじめた航空自由化協定(オープンスカイ協定)。また,以遠権の解釈を巡っては,日米航空交渉上の争点の一つになっている。以遠権を強調する米国側に対して,以遠権はあくまでも副次的な権限にすぎないと位置づける日本側が反論している。
