The official name of the law is "Law on the Promotion of Ainu Culture and the Dissemination and Awareness of Ainu Traditions, etc." Law No. 52 of 1997. It was promulgated on May 14, 1997. It is the first law to legally recognize the Ainu, a minority group in Japan, as an indigenous ethnic group. It stipulates that the national and local governments are responsible for carrying out cultural promotion measures such as training successors of the Ainu language and culture, research and studies, and public awareness raising, with the aim of "realizing a society in which the ethnic pride of the Ainu people is respected." However, the law did not include ethnic rights such as indigenous rights that the Ainu people had sought, and only a supplementary resolution stating that "indigenous status is a historical fact" was passed by the Cabinet Committees of both the House of Representatives and the House of Councillors. With this, the Hokkaido Former Aborigines Protection Law, which had been applied to the Ainu people since it was enacted by the Meiji government for the purpose of assimilation, was abolished. 正式名称は「アイヌ文化の振興並びにアイヌの伝統等に関する知識の普及及び啓発に関する法律」。平成9年法律 52号。 1997年5月 14日公布。日本の少数民族,アイヌを固有の民族として初めて法的に位置づけた法律で,「アイヌの人々の民族としての誇りが尊重される社会の実現」を目的に,国と地方自治体の責任としてアイヌ語やアイヌ文化の継承者の育成,調査・研究,国民への啓発などの文化振興策を行うと定めている。しかし,アイヌの人々が求めていた先住権などの民族の権利は盛込まれず,「先住性は歴史的事実」とする付帯決議が衆参両院の内閣委員会で可決されたにとどまった。これに伴って,明治政府が同化を目的に制定して以来,アイヌ民族に適用されてきた北海道旧土人保護法が廃止された。
