Prohibition of flow of land - Ryuchikinshirei

Japanese: 流地禁止令 - りゅうちきんしれい

This is a law issued by the Edo Shogunate in April 1722 (Kyoho 7). The original draft was prepared by the Hyojosho in December of the previous year. The Shogunate had banned farmers from buying and selling farmland with the Eternal Sales Prohibition Order issued in March 1643 (Kan'ei 20), but the law was issued because there was no end to the practice of farmland being effectively bought and sold through pawning and selling off. The first half of the law stated that "Since the Eternal Sales and Purchase of Farmland is prohibited, allowing pawning and selling off farmland would be the same as selling on a permanent basis, which goes against the original intent of the Eternal Sales and Purchase Prohibition Order," and that "in the future, the selling off of farmland will not be permitted at all."

1722年(享保7)4月に江戸幕府が出した法令。評定所で原案がつくられたのは前年12月。幕府は1643年(寛永20)3月発令の田畑永代売買禁止令によって農民の田畑売買を禁止したが，質入れ，質流れというかたちでの実質的な田畑売買があとを絶たなかったために発令した。法令の前半部分で〈田畑永代売買は禁止されているのだから，質入れ，質流れを認めることは結果的に永代売同然で田畑永代売買禁止令の本旨にもとる〉として〈今後いっさい田畑の質流れは認めない〉としたのである。
