Temporary Disposal Law for Land and House Leases in Disaster-Affected Cities

Japanese: 罹災都市借地借家臨時処理法 - りさいとししゃくちしゃっかりんじしょりほう

Law No. 13 of 1946. Temporary legislation enacted to adjust land and house leases in cities damaged by World War II. Tenants of damaged or evacuated buildings can acquire leases in preference to others for two years after the law comes into force. When a destroyed building is rebuilt, the tenant at the time of destruction can rent it out in preference. It also stipulates that leases of damaged or evacuated land can be asserted against third parties for five years from July 1, 1946, even if the lease or building is not registered. This law was later amended to apply mutatis mutandis to areas designated by government ordinance when buildings were destroyed by disasters such as major fires, earthquakes, and storms and floods, and was applied to many areas, such as the 1948 Fukui earthquake, the 1950 Atami fire, and the 1961 Hachinohe fire.

昭和 21年法律 13号。第2次世界大戦による罹災都市の借地借家関係の調整を目的として制定された臨時立法。罹災建物または疎開建物の借主は，本法施行後2年をかぎり，他の者に優先して借地権を取得できること。滅失した建物が再建されたときは，滅失当時の借主は優先的に賃借することができること。罹災土地または疎開跡地の借地権は，借地権または建物の登記がない場合でも，1946年7月1日から5年間は第三者に対抗できることなどを規定している。この法律は，その後の改正で，大火災，震災，風水害などの災害によって建物が滅失した場合にも，政令で地域を指定して準用されることになり，1948年の福井の震災，1950年の熱海の大火，1961年の八戸の大火など，かなりの地域に適用された。
