Japanese: 与同罪 - よどうざい

A legal term found in the Tang Code and the Japanese Code. Its definition is provided in the Mingrei Code. The four characters, hanza, zazhi, zaizhi, and yodozai, are used when a direct punishment is not set for the crime in question, but rather a punishment equivalent to that of another specific crime is quoted. However, in such cases, the main punishment for the main crime that is the basis is the punishment for the crime in question, and the punishments such as joumen and baizou that are added to the main crime do not apply mutatis mutandis to the crime in question. 唐律および日本律に見える法律用語。名例律にその定義が規定される。〈反坐〉〈坐之〉〈罪之〉〈与同罪〉の4者は，当該犯罪に対し直接刑を定めず，他の特定の罪名を引用して，それと同等の刑を科すときに用いられる。ただし，その場合，準拠とされる本罪の主刑を当該犯罪の刑とし，本罪に付加される除免，倍贓（ばいぞう）等は，当該犯罪には準用されない。また主刑が死刑となる場合も絞にとどめ，斬を科さない。【小林宏】
