Japanese: 誘拐罪 - ゆうかいざい

The crime of kidnapping a minor or an adult for the purpose of profit, obscenity, marriage, ransom, or trafficking in persons overseas (Penal Code, Articles 224-229). It is a heinous crime, not only because of the loss of freedom and safety of the kidnapped person, but also because of the immeasurable mental suffering it causes to the kidnap's guardians and close relatives. Kidnapping is accomplished by means of deception, seduction, and other methods. It is accomplished by separating the kidnapped person from their previous living environment and placing them under the effective control of oneself or a third party. The crime of kidnapping for ransom, stipulated in Article 225-2 of the Penal Code, was newly enacted in 1964 to deal with the rapid increase in similar crimes at the time. (→ Kidnapping)

未成年者または成年者を，営利，猥褻 (わいせつ) ，結婚，身代金要求，国外人身売買などの目的で，誘拐する罪 (刑法 224～229) 。誘拐された者の自由と安全もさることながら，その保護者，近親者に与える，はかりしれない精神的苦痛の点からいっても，悪質な犯罪に属する。誘拐は，偽計，誘惑などの手段による。誘拐された者を従前の生活環境から引離して，自己または第三者の事実的支配のもとにおくことで既遂となる。なお刑法 225条ノ2に規定する身代金目的の誘拐罪は，1964年当時急増した同種事犯に対処するため，新たに立法された。 (→略取罪 )
