People's lawsuit - Minshuusosho

Japanese: 民衆訴訟 - みんしゅうそしょう

A type of administrative litigation. A lawsuit filed by ordinary citizens or voters seeking the correction of actions by the state or public organizations that do not comply with the laws and regulations, regardless of whether or not they have a legal interest in the matter. Examples include lawsuits seeking the invalidation of elections and election results, and resident lawsuits (audit requests) under the Local Autonomy Act. However, because a public lawsuit does not have the nature of a legal dispute, it can only be filed when there is a specific legal provision that allows it.

行政訴訟の一種。自己の法律上の利益の有無にかかわらず，一般民衆あるいは選挙人としての資格で，国や公共団体の法規に適合しない行為の是正を求める訴訟。選挙無効および当選無効の訴訟，地方自治法上の住民訴訟（監査請求）等はその例であるが，民衆訴訟は，法律上の争訟の性質を持たないため，特にこれを認める法律の規定がある場合にだけ提起が許される。
