Civil Procedure Rules
Based on the power to make rules granted by Article 77 of the Constitution, the Supreme Court enacted detailed rules on civil procedure to ensure the fair and prompt administration of civil litigation. The Supreme Court Rules No. 2 of 1956 consisted of 69 articles in 5 parts: general provisions, litigation procedures in the first instance, appeals, retrials, and special provisions on bill litigation and check litigation. However, in line with the major revision of the Civil Procedure Code in 2000, it was revised to include special provisions on small claims litigation in Part 6, making it 9 parts and 240 articles (Supreme Court Rules No. 5 of 1996).

憲法 77条により認められた規則制定権に基づいて,最高裁判所が民事訴訟の公正かつ迅速な運用をはかるべく制定した,民事訴訟手続に関する細則。昭和 31年最高裁判所規則2号は,総則,第1審の訴訟手続,上訴,再審,手形訴訟および小切手訴訟に関する特則の5編 69ヵ条からなっていたが,2000年の民事訴訟法の大改正にあわせて改正され,第6編少額訴訟に関する特則などが追加され9編 240条となった (平成8年最高裁判所規則5号) 。
