Reckless intent - Mihitsu no Koi

A type of intent, a legal term referring to a case where the occurrence of a result is uncertain, but one foresees that it may occur, and allows (accepts) it to occur. There are two types of intent: "definite intent," where the occurrence of a result is recognized as certain, and "uncertain intent," where the occurrence is merely recognized as uncertain. Imperfect intent belongs to the latter. The issue of whether imperfect intent can be evaluated as intent is the distinction between the two in relation to "conscious negligence." According to the theory of acceptance (the prevailing theory and precedent), when the occurrence of a result is accepted, it is considered to be intent (imperfect intent), and when this acceptance is lacking, it is considered to be negligence (conscious negligence), whereas the theory of probability distinguishes between the two based on whether one recognizes that the probability of the occurrence of the result is quite high.

故意の一種で、結果の発生が不確実であるが、発生するかもしれないと予見し、かつ、発生することを認容(容認)する場合をいう法律用語。故意には、結果の発生を確定的なものとして認識する「確定故意」と、これを不確定なものとして認識するにすぎない「不確定故意」とがある。未必の故意は後者に属する。未必の故意を故意と評価するかどうか、「認識ある過失」との関係で両者の区別が問題となる。認容説(通説・判例)によれば、結果の発生を認容する場合が故意(未必の故意)であり、この認容を欠く場合が過失(認識ある過失)であると解されるのに対し、蓋然(がいぜん)性説では、結果発生の蓋然性が相当高度であると認識しているか否かにより両者が区別される。
