Mitsubishi Plastics Incident

This court case arose when a private company refused to hire a worker on probation because of his beliefs and beliefs, and it raised questions about the effectiveness of constitutional human rights protections between private individuals, and the relationship between workers' freedom of belief and belief and "equality under the law" and private companies' property rights and freedom of business, and ultimately the framework and nature of Japanese capitalism. Takano Tatsuo, who graduated from the Faculty of Law at Tohoku University in 1963 and was employed by Mitsubishi Plastics, Inc., was refused permanent employment just before the end of his three-month probationary period on the grounds that he had not included certain points that should have been included in his personal record and that his beliefs were unfavorable to the company.

私企業が試用期間にある労働者の思想･信条を理由として本採用を拒否したところから起こった裁判事件で，私人相互間における憲法上の人権保障の効力，労働者の思想･信条の自由や〈法の下の平等〉と私企業の財産権，営業の自由との関係を問題とすることによって，ひいては日本の資本主義の枠やあり方をも問題とするものであった。　1963年東北大学法学部を卒業し三菱樹脂株式会社に就職した高野達男は，3ヵ月の試用期間の終了する直前に，身上調書に記載すべき点が記載されていないこととその思想が会社にとって好ましくないことを理由として本採用を拒否された。
