Habeas corpus

Japanese: ヘビアス･コーパス（英語表記）habeas corpus

A type of British court warrant. It developed around the beginning of the 13th century and means "to bring in the person in custody." It commands the person in custody to present the person in custody to the court so that the court can investigate the reason for the detention and take appropriate action based on the results. In the 17th century, it was used as a means of protection of personal freedom against the abuse of sovereign prerogatives, especially in cases when Stuart kings arbitrarily arrested people and continued them in custody without trial. The Habeas Corpus Act of 1679 made compliance with this warrant explicitly mandatory.

イギリスの裁判所令状の一つ。13世紀初めころから発達したもので，〈身柄を持参すべし〉という意味。裁判所が拘禁の理由を取り調べ，その結果にもとづいて適当な処分を行うため，被拘禁者の身柄を裁判所に提出すべきことを拘禁者に命ずるもの。とくに17世紀に，スチュアート朝の国王がみだりに人民を逮捕して審理を行わずに拘禁を続けた場合に，そのような君主大権の濫用に対する人身の自由保護のための救済手段として活用され，1679年の〈ヘビアス･コーパス･アクト(人身保護法)〉によって，この令状の順守が明確に義務づけられるようになった。
