A leading Russian legal scholar. After graduating from Kiev University and studying abroad in Berlin, he was a professor at St. Petersburg University from 1898 to 1918. After the 1905 revolution, he became a member of the Central Committee of the Kadet (Constitutional Democratic Party). After the October Revolution in 1917, he was invited to Warsaw University, where he served as a professor until his death in 1931. He constructed his own psychological theory of law under the influence of WM Bund's psychology and E. Mach's empirical criticism. From the standpoint of seeing the foundation of legal phenomena in legal experience as an "ethical emotion" with an "imperative and attributive" character, he asserted the existence of a broad "intuitive law" outside of positive law (formal law), and explained legal policy from the perspective that this living "intuitive law" has a peaceful and revolutionary effect on the dismantling and reorganization of fixed positive law.

ロシアの代表的法学者。キエフ大学卒業後ベルリン留学を経て,1898年から1918年までペテルブルグ大学教授。1905年の革命後カデット(立憲民主党)中央委員。17年の十月革命後ワルシャワ大学に迎えられ,31年みずからの生涯を絶つまで同大学教授の地位にあった。W.M.ブントの心理学,E.マッハの経験批判論の影響のもとに独自の心理学的法理論を構築した。〈命令的・帰属的〉性格をもつ〈倫理的情緒〉としての法的体験に法現象の基礎をみる立場から,実証法(公式法)の外に広く〈直観法intuitive law〉の存在することを主張し,この生きた〈直観法〉が固定した実証法の解体・再編に平和的・革命的に作用するという観点で法政策学を説いた。
