Unfair trade practices

Japanese: 不公正な取引方法 - ふこうせいなとりひきほうほう

A type of business conduct prohibited by the Antimonopoly Act. Unfair trade practices are classified into acts that use unfair competitive means (abuse of economic power in the competitive aspect) and acts that unfairly use a dominant trading position to restrict the other party's competitive function (abuse of economic power in the competitive aspect). Both of these illegal acts are specified by the Fair Trade Commission through public notice based on Article 2, Paragraph 9, Items 1 to 6 of the Antimonopoly Act. There are two types of designations: "general designations" (Fair Trade Commission Public Notice No. 11 of 1953) that cover unfair trade practices in all industries, and "special designations" that cover unfair trade practices specific to specific industries.

独占禁止法で禁止されている，事業者の行為の一類型。不公正な取引方法は，不当な競争手段を用いる行為 (競争面における経済力の濫用) と，取引上の優越的地位を不当に利用して相手方の競争機能を制限する行為 (取引面における経済力の濫用) に類別される。これら違法行為は，いずれも公正取引委員会が独占禁止法2条9項1～6号に基づいて告示により，指定を行うことにより具体化される。この指定には全業種に関する不公正な取引方法を内容とする「一般指定」 (昭和 28年公正取引委員会告示 11号) と特定業種に固有な不公正な取引方法を内容とする「特殊指定」とがある。
