In a civil or administrative lawsuit, the party against whom a lawsuit is filed, the passive party in the first instance lawsuit. A term used for the plaintiff. It must be specified in the complaint (Civil Procedure Code). Who is the defendant is generally considered to be formally determined by the description in the complaint. In criminal procedure, a person who is treated as a passive party, or a person against whom a lawsuit has been filed and a public prosecution has been filed, is called a defendant.
