Publications that are made in violation of the law or without meeting the requirements of the law. In most cases, they refer to publications that conflict with certain forms of censorship of speech, or publications that are considered to be contrary to public order and morals (such as invasion of privacy or obscene literature), and they often overlap with underground and secret publishing. Publications that violate copyright law are usually distinguished as pirated copies. In Japan, examples of the former are publications made with an anti-establishment or anti-state power stance during the period when censorship laws such as the Publication Act were severe before World War II, and this was rather prevalent. 法に反して,あるいは法で定められた要件を備えずになされる出版。多くは,なんらかの言論統制がしかれている場合にそれに抵触する出版と,一般の公序良俗に反するとされる(プライバシーの侵害,猥褻(わいせつ)文書など)出版をいい,地下出版,秘密出版と重なるところが多い。著作権法違反にあたる出版は,海賊版として区別されるのがふつうである。日本では第2次世界大戦前の出版法などの言論統制各法によって取締りが厳しかった時代に反体制・反国家権力の立場でなされた出版が前者の例であり,それはむしろ盛んであった。
