Anti-Prostitution Law - baishunboushiho

This law was enacted on May 24, 1956, with the aim of preventing prostitution. It was Act No. 118 of 1956. From the viewpoint that prostitution is an infringement of human dignity, against sexual morality, and disturbs the good customs of society, Article 3 stipulates that "No person shall engage in prostitution or become a prostitute." Here, "prostitution" means sexual intercourse with an unspecified partner for which compensation is received or promised (Article 2). This law does not punish the mere act of prostitution or becoming a prostitute, but it does punish acts that promote prostitution, such as soliciting someone to become a prostitute in a manner that is visible to the public, arranging prostitution, providing an advance or funds for the purpose of prostitution, entering into a contract to engage in prostitution, or engaging in the business of engaging in prostitution (Articles 5 to 14). The law also provides for the imposition of guidance measures (Articles 17 to 33) on women aged 20 or older who commit crimes such as solicitation (Article 5), and provides for protective rehabilitation measures for women who are at risk of engaging in prostitution based on their sexual conduct or environment (Articles 34 to 40).

売春を防止する目的で、1956年5月24日に制定された法律。昭和31年法律第118号。この法律は、売春が人としての尊厳を害し、性道徳に反し、社会の善良の風俗を乱すものであるという観点から、その第3条で「何人(なんぴと)も、売春をし、又はその相手方となつてはならない」と規定している。ここに「売春」とは、対償を受け、または受ける約束で、不特定の相手方と性交することをいう（2条）。この法律は、単なる売春行為やその相手方となること自体は処罰の対象とはしていないが、公衆の目に触れるような方法で売春の相手方となるよう勧誘するとか、売春の周旋、売春目的の前貸・資金提供、売春をさせる契約、売春をさせる業など売春を助長する行為は処罰される（5条～14条）。また、同法は、勧誘等の罪（5条）を犯した満20歳以上の女子に対する補導処分（17条～33条）を規定するとともに、性行または環境に照らして売春を行うおそれのある女子に対する保護更生の措置を講じている（34条～40条）。
