City Planning Act

City Planning Act
In a broad sense, it refers to laws related to the planned development of cities in general, including the City Planning Act in the narrow sense, the Land Readjustment Act, the Urban Redevelopment Act, etc. In a narrow sense, it refers to the City Planning Act (Act No. 100 of 1968), which is the basic law related to city planning. This was enacted to replace the old City Planning Act (Act No. 36 of 1919), and stipulates the contents of city plans, decision-making procedures, regional district systems, development permission systems, city planning restrictions such as building restrictions, the implementation of city planning projects and the approval of city planning projects, the Central Council for City Planning, as well as land funds and tax measures. In particular, in order to prevent disorderly expansion of urban areas, it distinguishes between urbanization areas and urbanization control areas, and stipulates various measures for each area.

広義には,都市の計画的な整備に関する法律一般をさし,狭義の都市計画法のほか,土地区画整理法,都市再開発法などを含む。狭義には,都市計画に関する基本法である都市計画法 (昭和 43年法律 100号) をさす。これは,旧都市計画法 (大正8年法律 36号) に代えて制定され,都市計画の内容,決定手続,地域地区制,開発許可制,建築制限などの都市計画制限,都市計画事業の施行ならびに都市計画事業の認可,都市計画中央審議会などのほか,土地基金,税制上の措置などについて定める。特に,市街地の無秩序な拡張を防止するために,市街化区域と市街化調整区域とを区別し,それぞれの区域におけるさまざまな措置などを定めた。
