Right to claim compensation

Japanese: 代償請求権 - だいしょうせいきゅうけん

For example, if a third party destroys or damages the object of the debt, causing the debtor to be unable to perform and at the same time acquiring a right to claim damages against the third party or a right to claim insurance money, or if the land that is the subject of a sale is requisitioned for public use and the seller acquires a right to claim compensation, it is considered that the creditor may demand the transfer of the compensation if the debtor acquires a benefit that constitutes compensation for the object of performance due to the same cause that caused the debtor to be unable to perform.

たとえば，債務の目的物を第三者が滅失または毀損せしめたため，債務の履行不能を生ずると同時に債務者が第三者に対する損害賠償請求権を取得したり保険金請求権を取得した場合，あるいは売買の目的たる土地が公用徴収されたため，売主が補償金請求権を取得した場合のように，履行不能を生ぜしめたのと同一の原因によって債務者が履行の目的物の代償となる利益を取得した場合には，債権者はその代償の譲渡を請求しうると考えられている。
