The meaning of wartime legislation is not necessarily unambiguous, but it can be considered to be roughly the same as what we call emergency legislation today. This usage of emergency legislation was also commonly used from the Meiji period until World War II, and became a dead term after the war, but in recent years it has been revived and has become more widely known. In any case, these concepts have a wide range of meanings in response to the changes and expansion of the concept of war. 戦時(立)法の意味は必ずしも一義的ではないが,今日いうところの有事立法とほぼ同義と考えてよい。この有事立法なる用法もまた,明治以来第2次大戦前に常用され戦後いったんは死語となったものであるが,近年,むしろこのほうが復活して人口に膾炙(かいしや)することとなった。いずれにしてもこれらの概念は,戦争概念の変遷や拡大に対応して広狭の意義がある。 近代までの戦争概念は,おおむね国家間の武力抗争自体を中心に構成されてきた。
