Government Contracts

Japanese: 政府契約 - せいふけいやく

A private law contract in which the government is one of the parties and which is concluded as a method of budget execution. The Act on Prevention of Delays in Payment for Government Contracts (promulgated in 1949) defines government contracts as "contracts in which the government is one of the parties and in which the government is to pay for the completion of construction work, the provision of work or other services, or the delivery of goods by persons other than the government" (Article 2), and regulates their conclusion, payment, etc. Typical government contracts include contracts for the delivery of goods and contracts for civil engineering and construction work.

国を一方の当事者とする契約で，予算の執行方法として締結される私法契約。政府契約については，〈政府契約の支払遅延防止等に関する法律〉(1949公布)において，〈国を当事者の一方とする契約で，国以外の者のなす工事の完成若しくは作業その他の役務の給付又は物件の納入に対し国が対価の支払をなすべきものをいう〉(2条)と定義され，その締結，対価の支払等が規制されている。物品の納入契約や土木建築請負契約などが典型的な政府契約である。
