Institutional theory - théorie de l'institution

Japanese: 制度理論 - せいどりろん（英語表記）théorie de l’institution

A theory put forward by the French public law scholar M. Aurieu, which was proposed as a way to overcome the French individualistic legal theory and the German legal positivist theory of legal personality at the time. It is a theory with many different aspects and is not easy to grasp in a unified manner, but it is said to include the following three research themes: first, research on institutions considered as "objective social things," second, the representational process as the legal mechanism by which these institutions are created and continue to exist, and third, research on collective institutions or legal personality.

フランスの公法学者M.オーリウの唱えた理論。当時のフランスの個人主義的法理論およびドイツの法実証主義的法人格理論を克服するものとして提唱された。それはさまざまな側面を有する理論で統一的な把握は容易でないが，次の三つの研究を含むとされる。第1に，〈客観的な社会的なるもの〉として考えられた制度に関する研究，第2に，その制度が生成存続していく法的メカニズムとしての表象(代表)的過程，第3に団体的制度もしくは法人格の研究である。
