〘Noun〙① From the Edo period to the Meiji period, when someone was unable to pay their debts, the government would issue a sentence and enforce the execution, forcing them to provide all of their assets to pay off their debts. Those who received this punishment lost all of their rights and qualifications as ordinary people until they paid off all of their outstanding debts. Furthermore, the obligation to pay off the outstanding debts extended to their descendants. It was abolished in 1891 ( Meiji 24 ) with the enforcement of the old Commercial Code. It is equivalent to modern-day bankruptcy. 〘名〙① 江戸時代から明治期まで、負債を支払うことができなくなった者があった場合、官の宣告と強制執行によってその全財産を提供させ、負債の支払いにあてるよう強制すること。この処分を受けた者は、未払いの負債を全部支払うまで、常人としての種々の権利や資格を失う。また、その未払いの負債を支払う義務は、子孫にまで及んだ。明治二四年(一八九一)旧商法の施行によって廃止。今の破産にあたる。身代切り。※禁令考‐後集・第二・巻一三・享保六年(1721)六月「総体身代限りに申付候儀、店借りに候はば、道具計を不残取上げ可申候」② 全財産をつぎこむこと。自分のものを全部出してしまうこと。身代切り。※洒落本・短華蘂葉(1786)「『おじゃまながらたばこちっと』と銀かなぐのこしさげ出す。身体かきりの見てくれ也」
