The concept of socialist law was established in the former Soviet Union in the 1930s and has since come into widespread use. In the Soviet Union, the law under the Soviet regime after the October Socialist Revolution was understood as "proletarian law" or "Soviet law." It was considered a "transitional law" until the state and law "died" with the completion of the construction of a socialist society, and was often critically recognized as "bourgeois law" in quotation marks. In the 1930s, based on the recognition that socialism had basically been realized in the Soviet Union, the need to establish a new stage of legal system was advocated, and this was understood as "Soviet socialist law," and the idea of viewing the entire legal formation after the revolution as the formation and development of socialist law was established. 社会主義法という概念は,旧ソ連において1930年代に確立され,その後広く用いられるようになった概念である。 ソ連では,十月社会主義革命後のソビエト政権下の法は〈プロレタリア法〉〈ソビエト法〉という概念でとらえられていた。それは,社会主義社会建設の完成によって国家と法が〈死滅〉するに至るまでの〈過渡期の法〉とみなされ,しばしば,かっこつきの〈ブルジョア法〉として批判的に認識されていた。30年代に入って,ソ連で社会主義が基本的に実現された,という認識のうえに,新しい段階の法体系を確立する必要が唱えられ,これを〈ソビエト社会主義法〉ととらえ,ひるがえって革命後の法形成全体を社会主義法の形成・発展とみる考え方が確立されてゆく。
