Advisory body - Simon Kikan

An administrative body that has the authority to conduct investigations and deliberation at the request of an administrative agency or on its own initiative, and to present opinions that should be of reference to the administrative agency. Legally, they are established as auxiliary bodies to administrative agencies and executive agencies of the national and local governments, and are given names such as councils, conferences, and research committees (Article 8 of the National Administrative Organization Act, Article 138-4, Paragraph 3 of the Local Autonomy Act, etc.). There are many such bodies, such as the City Planning Council, the Central Social Insurance Medical Council, and the Local Government System Research Council. The opinions and reports of advisory bodies are not legally binding on administrative agencies and are merely for reference, but in light of the purpose of establishing advisory bodies (democratization and scientification of administration, etc.), they should be respected to the greatest extent possible.

行政庁の求めに応じ、または自ら進んで調査審議を行い、行政庁に対し参考となるべき意見を陳述する権限をもつ行政機関。法令上は、国や地方公共団体の行政機関や執行機関に附属機関として設置され、審議会、協議会、調査会などの名称が付されている（国家行政組織法8条、地方自治法138条の4第3項ほか）。都市計画審議会、中央社会保険医療協議会、地方制度調査会など、その数は多い。諮問機関の意見・答申は、行政庁を法的に拘束するものではなく参考意見にとどまるが、諮問機関の設置目的（行政の民主化・科学化など）に照らして、最大限度尊重されるべきであろう。
