In civil proceedings at summary courts, judicial commissioners are private citizens who assist in settlements or attend hearings to express their opinions (Civil Procedure Act, Article 279). Unlike jurors and lay judges, they do not participate in trials, but they are allowed with the aim of reflecting social common sense in trials and realizing friendly proceedings. Each year, the district court selects at least 10 judicial commissioners per summary court from among those with good sense and others deemed appropriate (Judicial Commissioner Rules, Articles 1 and 3). From among them, at least one person is designated for each case, but the use of judicial commissioners is left to the discretion of the court, and in reality, they are not used very often.
