Car registration - jidousha toroku

Japanese: 自動車登録 - じどうしゃとうろく

This is the first legal procedure required for a car owner to use a car on public roads, and is based on the Road Transport Vehicles Act. This system has both administrative and civil registration characteristics. The administrative registration aims to grasp the actual state of car use, which is the basis of land transportation, prevent and investigate traffic accidents, car theft, and other car crimes, grasp the taxable subjects of various taxes such as automobile tax, and ensure compulsory insurance coverage to provide relief to victims of car accidents. The civil registration aims to notarize the ownership of a car, protect the rights of the legitimate owner regarding the acquisition and loss of the car, enable the establishment of mortgages on cars by treating them like real estate, and ensure the safety of transactions such as the sale of cars.

自動車の所有者が公道上で自動車を使用するために，まず第一に必要な法的手続で，道路運送車両法に基づく。この制度は，行政登録の性格と民事登録の性格とをもつ。行政登録としては，陸上交通の基礎となる自動車使用の実態の把握，交通事故，自動車の盗難，その他自動車による犯罪の防止と捜査，自動車税等各種税金の課税対象の把握，自動車事故被害者救済のための強制保険加入の確保，などを目的とする。民事登録としては，自動車の所有権を公証し，自動車の得喪（とくそう）について正当な所有者の権利の保護，および不動産に準じた取扱いによる自動車への抵当権の設定を可能にするとともに，自動車の販売などの取引の安全確保を目的とする。
