Practice as fact - Practice as fact
This refers to customs that exist in society in general, but have not yet been recognized as legally binding. Since they are different from customary law, they do not have the same effect as laws (Case Law 2), but customs that are not contrary to public order and good morals take precedence over optional laws and regulations as the standard for interpretation (Civil Code 92). In other words, if the parties do not make a special agreement, the content of legal acts will be interpreted and determined in accordance with custom, as long as it is not contrary to public order and good morals.

一般社会に存在する慣習であるが,まだ法的拘束力までは認められていない程度の慣習をいう。慣習法とは異なるので法律と同一の効力は有しないが (法例2) ,公序良俗に反しない事実たる慣習は任意法規に優先して解釈の基準となる (民法 92) 。すなわち,当事者間で特別の定めをしていない場合には,公序良俗に反しない限りにおいて,慣習に従って法律行為の内容が解釈され決定されることになる。
