Notice - Kokuji

An act of officially informing the public of matters decided by an administrative agency, or a form of such public notice. Article 14, paragraph 1 of the National Government Organization Law generally stipulates the right of each minister, each committee, and each agency to issue notices, but other individual laws and regulations may provide the basis for such notices. Notices are generally published in the Official Gazette or the Public Notices. Examples of notices include the controlled amount under the Price Control Order, insurance medical expenses, learning guidelines, public assistance standards, town name changes, naturalization permits, designation of protected forests, environmental standards, the government purchase price of rice, and standard and specific standard prices of daily necessities determined by the National Livelihood Stabilization Emergency Measures Law. There is much dispute over its legal nature, but it is said to have various characteristics depending on the case, such as general disposition or legislative act, notification act, factual act or guidance and advice, and guidance guidelines.

行政庁が決定した事項を一般に公式に知らせる行為、またはその公示の形式の一種。国家行政組織法第14条1項は一般的に、各大臣、各委員会および各庁の長官の告示発布権を規定しているが、そのほか個別の法規に根拠規定が置かれることがある。告示は一般に官報または公報に掲載される。告示の実例としては、物価統制令上の統制額、保険医療費、学習指導要領、生活保護基準、町名変更、帰化許可、保安林指定、環境基準、米穀の政府買入価格、国民生活安定緊急措置法により決定される生活関連物資等の標準価格や特定標準価格など多数ある。その法的性質は争いが多いが、一般処分ないし立法行為、通知行為、事実行為ないし指導助言、指導要綱など、場合により種々の性質をもつといわれている。
