Public land exchange

Japanese: 公用換地 - こうようかんち

This refers to the process of determining the layout of public facilities according to a certain plan, reorganizing land parcels and changing their characteristics, allocating replacement land, and relocating existing buildings to the replacement land, without making any changes to the previous land rights. It is a type of public burden that involves changing the parcels and characteristics of land within a certain area and forcibly exchanging and dividing land ownership regardless of the wishes of the rights holders in order to promote the rational use of land. Land readjustment projects based on the Land Readjustment Act (promulgated in 1954) and land improvement projects based on the Land Improvement Act (promulgated in 1949) are carried out using this method.

一定の計画に従い，公共施設の配置を定めるとともに，土地の区画を整理し形質に変更を加え，換地を割り当て，既存の建物を換地に移転したうえで，従前の土地の権利関係になんらの変更を加えることなく，そのまま換地上に移行させる過程をいう。土地の合理的な利用を増進するために，一定地区内の土地の区画，形質を変更し，権利者の意思にかかわりなく，土地の所有権を強制的に交換分合することを内容とする一種の公用負担である。土地区画整理法(1954公布)に基づく土地区画整理事業や，土地改良法(1949公布)に基づく土地改良事業がこの手法によって行われている。
