Equity - Koheiho (English spelling) equity
The legal principles and remedies developed in the English Court of Lord Chancellor. Today, it is enforced as common law in both England and America. By the end of the 13th century, many common law principles had become too technical for the English common law courts to handle. Parties unable to reach a satisfactory resolution in the courts turned to the King and the Council for a resolution. It was customary to petition the Lord Chancellor, who acted as the "keeper of the King's conscience." Thus, during the 14th and 15th centuries, the Lord Chancellor established a court to deal with cases that could not be satisfactorily resolved by the common law (→ Ellesmere). Unlike common law judges, the Lord Chancellor relied primarily on moral equity rather than strict legal principles. The Lord Chancellor was not bound by precedents like the common law judges. The Lord Chancellor had broad powers to adjudicate as he saw fit, and was less bound by procedural formalities. By the mid-17th century, the laws of equity thus developed had become a recognised part of English law.

イギリスの大法官裁判所で発達した法原則ならびに法救済。現在ではイギリスにおいてもアメリカにおいてもコモン・ローと同等に執行されている。 13世紀末になると数多くのコモン・ローの法原則のなかには,あまりにも技術的になりすぎたものがあり,イギリスのコモン・ロー裁判所では裁判を行えないような事態が生じてきた。裁判所で満足な解決を得られない当事者は国王と councilに解決を求めた。このような場合,「国王の良心の保持者」としての大法官に請願するのが慣行になっていたからである。このため 14世紀と 15世紀の間に大法官はコモン・ローでは十分な解決を得られない事件に対処するための裁判所を築いた (→エルズミア ) 。コモン・ロー裁判官とは異なって,大法官は厳格な法原則よりも主として道義的衡平に依拠した。大法官はコモン・ロー裁判官のような先例に拘束されることがなかった。大法官は適当と思う裁判を行う広い権限をもち,手続上の形式にあまり拘束されなかった。 17世紀の中頃までにはこのようにしてつくり上げられた衡平法はイギリス法の一部として認められるようになった。
