Fair Trial - Kohei Nasaiban
In a country governed by the rule of law, in order to ensure the protection of the rights of its citizens, it is necessary to strive to achieve a fair trial in all legal disputes. This is particularly emphasized in criminal cases, which involve the serious issue of punishment, and the Constitution of Japan also includes specific provisions to safeguard justice for criminal defendants (Article 37, paragraph 1). In order to guarantee a fair trial, the "independence of the judicial power" must first be guaranteed. On top of that, it is necessary, first, that the organization and composition of the courts be fair, and, second, that the procedures be carried out appropriately.

法治国家においては,国民の権利保障を確かなものとするために,すべての法律上の争訟において公平な裁判の実現を図らなくてはならない。そのことは,刑罰という重大な問題にかかわる刑事事件でとくに強調され,日本国憲法も刑事被告人についての保障規定をとくに設けている(37条1項)。公平な裁判を担保するには,〈司法権の独立〉がまず保障されなくてはならない。そのうえで,第1に裁判所の組織・構成が公平であること,第2に手続の遂行が適正であることが必要である。
