Among the acts that impair the utility of other people's property, known as the crime of destruction, this crime punishes the destruction of buildings and ships that have particularly important financial value more severely than the general crime of destruction of property, excluding acts that fall under the category of the crime of destruction of documents. Unlike the crime of destruction of property, it is not a crime that requires a complaint. The punishment is imprisonment for up to five years (Article 260 of the Penal Code). If the destruction of a building or ship results in death or injury, the punishment is more severe than the crime of assault (same article). 他人の物の効用を損なういわゆる毀棄罪(ききざい)にあたる行為のうち,文書毀棄罪にあたるものを除き,とくに重要な財産的価値をもつ建造物,艦船の損壊を,一般の器物損壊罪より重く処罰するもの。器物損壊罪と異なり,親告罪ではない。刑は5年以下の懲役(刑法260条)。建造物,艦船の損壊の結果,人を死傷させたときは,傷害罪の罪に比較して,重い刑で処断する(同条)。建造物とは,家屋その他これに類似する土地に定着した工作物をさす。
