Depending on the type of debtor's property that is the subject of execution, it can be divided into tangible movable property execution, property right execution, real estate execution, and ship execution, but basically, it takes three steps: seizure, liquidation by auction or other means, and satisfaction of the creditor with the proceeds (dividend). In contrast, execution based on claims other than monetary claims is called non-monetary execution (Civil Execution Law, Article 168 et seq.). This is broadly divided into execution of claims involving the delivery or eviction of property, and execution of claims involving the debtor performing a pure act (including omission) unrelated to property, and the general consensus is that direct enforcement is used for the former, and indirect enforcement or substitute execution is used for the latter. 金銭債権に基づく強制執行(民事執行法43条以下)。執行の対象とする債務者の財産の種類によって,有体動産執行・財産権執行・不動産執行・船舶執行に分かれるが,基本的には差押え,競売などによる換価,その売得金による債権者の満足(配当)という3段階がとられる。これに対し,金銭債権以外の債権に基づく執行を非金銭執行という(民事執行法168条以下)。これは物の引渡し・明渡しを内容とする債権の執行と,債務者が物と関係のない,純粋の行為(不作為を含む)をすることを内容とする債権の執行とに大別され,前者には直接強制,後者には間接強制または代替執行の方法がとられるとするのが通説。
