Conspiracy - Joint criminal conspiracy

When several people conspire to commit a crime and some of them carry out the crime, those who did not participate in the crime are also held responsible for their joint crimes. This is called conspiracy joint criminal liability. Many academics have been critical of conspiracy joint criminal liability, arguing that those who were not involved in the crime were merely instigators or accomplices, but legal precedents have consistently punished conspirators as joint criminal liability. Recently, the number of supporters among scholars has increased, and theories that explain it as similar to indirect criminal liability along with the joint intention theory that existed before World War II, and theories that use the concept of control over actions as a basis for it, are also being strongly advocated. Article 27, paragraph 2 of the revised Penal Code also provides for conspiracy joint criminal liability.

数人が犯罪を共謀し，そのうちの一部の者が犯罪を実行した場合，実行を分担しなかった者にも共同正犯の責任を問うときに，これを共謀共同正犯という。学説の多くは，実行に関与しなかった者は教唆犯ないしは従犯にすぎないとして共謀共同正犯に批判的であったが，判例は一貫して共謀者をも共同正犯として処罰してきた。最近，学者のなかにも支持者がふえ，第2次世界大戦前からの共同意思主体説とともに間接正犯類似のものとして説明する学説や，行為支配の観念を用いて基礎づける学説も有力に主張されている。また，改正刑法草案 27条2項も共謀共同正犯を規定している。
